Terms of Service

Last updated: September 9, 2026

This is a template starting point, not legal advice. It has not been reviewed by a lawyer. Given the sensitive personal data some campaigns handle, get this reviewed by counsel — and fill in your actual company legal name, refund policy, and governing-law jurisdiction — before relying on it.

1. Who we are, and what these terms cover

Cole ("Cole," "we," "us," or "our"), operated by GetCole Innovation Inc, provides an AI-powered outreach agent that sources leads, sends outreach messages, conducts AI voice qualification calls, and books meetings on behalf of businesses ("you," "your," or a "Customer"). By creating an account or using Cole, you agree to these Terms of Service ("Terms"). If you don't agree, don't use Cole.

2. What Cole does

Cole runs an automated outreach pipeline on your behalf, which may include:

  • Sourcing leads via structured B2B search or partnership/community outreach
  • Sending outreach emails using content and templates you configure
  • Classifying inbound replies and triggering follow-up actions
  • Placing AI-driven voice calls to qualify leads and book meetings, which may be recorded and transcribed
  • Booking meetings via your connected calendar
  • Sending meeting reminders and recovering no-shows
  • Optionally syncing lead and meeting data with a CRM you connect (e.g. HubSpot, HighLevel)

3. Your responsibilities

You are solely responsible for the content of your outreach, the accuracy of any ICP or targeting criteria you provide, and compliance with all applicable laws governing your outreach — including but not limited to spam, telemarketing, call-recording consent, and data protection laws in every jurisdiction where your leads are located. Cole is a tool you direct; you remain responsible for how it is used on your behalf. You must not use Cole to contact people who have opted out, to send unlawful or deceptive content, or to target populations in a way that violates applicable law.

4. AI-generated content and calls

Outreach messages and voice-call scripts are generated or executed by AI models based on the configuration you provide. AI-generated content and AI-conducted calls may occasionally be inaccurate, and voice calls may be recorded. You are responsible for reviewing your own campaign configuration and for ensuring your use of AI voice calling complies with call-recording consent and telemarketing laws applicable to the people you contact.

5. Partnership & community outreach

For campaigns targeting communities or demographics that structured search can't reach, Cole may identify and contact organizations to propose co-marketing partnerships. No partnership becomes active, and no data-sharing arrangement takes effect, without your explicit approval.

6. Fees, billing, and credits

Activating a campaign requires a one-time activation fee, which includes a starter batch of prepaid credits for metered actions (such as AI voice calls). Additional usage beyond your credit balance may require purchasing additional credits. All fees are processed via Stripe. You may cancel and receive a full refund of your activation fee if you do so within 2 hours of payment. After that 2-hour window, activation fees are non-refundable, except where required by law.

7. Third-party services

Cole relies on third-party services to operate, including Stripe (payments), Clerk (authentication), Vapi (AI voice calling), Cal.com (scheduling), Resend (email delivery), Anthropic (AI models), and Apollo/Clay (lead data). Your use of Cole is also subject to the applicable terms of these providers where relevant.

8. Account suspension and termination

We may suspend or terminate your access if you violate these Terms, misuse the platform, or use it for unlawful outreach. You may stop using Cole at any time.

9. Disclaimers and limitation of liability

Cole is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of Cole, including damages arising from AI-generated content, missed meetings, or third-party service outages, to the maximum extent permitted by law.

10. Governing law

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of Cole after an update constitutes acceptance of the revised Terms.
